The contents of this software, including, without limitation, the materials, are provided "as is," without any warranty of any kind, either express, implied, or statutory, including, but not limited to, any warranty that the software will conform to specifications, any implied warranties of merchantability, fitness for a particular purpose, and freedom from infringement, and any warranty that the documentation will conform to the program, or any warranty that the software will be error free. In no event shall DoD be liable for any damages, including, but not limited to direct, indirect, special or consequential damages, arising out of, resulting from, or in any way connected with this software, whether or not based on warranty, contract, tort or otherwise, whether or not injury was sustained by persons or property or otherwise, and whether or not loss was sustained from, or arose out of the results of, or use of, the software or services provided hereunder.
Copyright Notice
The DoD BMO BioAPI Conformance Test Suite (BioAPI CTS) software was developed under contract by the DoD BMO contractor Booz Allen Hamilton and its subcontractor (hereinafter referred to as "Contractors"), for the DoD and funded exclusively by government funding. It may be freely copied and used in non-commercial products, assuming proper credit is given. User agrees to acknowledge this use to the DoD BMO, and acknowledges the DoD BMO-related contributions to the User's work.
This release of the DoD BMO BioAPI Conformance Test Suite (BioAPI CTS) provided under this disclaimer is a January 2006 release of the U.S. Department of Defense Biometrics Management Office (DoD BMO).
The January 2006 release of BioAPI CTS Version 2.2 software is based on the Fourth Draft of INCITS Project 1703-D - "Information Technology Conformance Testing Methodology for ANSI INCITS 3582002, BioAPI Specification" and the Final Committee Draft (FCD) of ISO/IEC Project 24709-1 "Conformance Testing for BioAPI - Part 1: Methods and Procedures", and is subject to change.
DoD reserves the right to make changes to the BioAPI CTS software or documentation without notice as deemed appropriate by the Government. Use of this software does not guarantee that any support concerning the BioAPI CTS or its components will be available to Users, nor does it guarantee that defects or errors will be corrected by any pre-defined dates.
Indemnification
User agrees to indemnify DoD, its contractors, and their employees from and against any action, claim, demand, or liability, including reasonable attorney's fees, if such action is based upon: (1) any allegation that a modification or alteration of the BioAPI CTS by the user infringes a third person's copyright or trademark right, or misappropriates a third person's trade secret; and/or (2) any allegation that the user's use of the BioAPI CTS is libelous, defamatory, violates any publicity or privacy right of a third person, places a third person in a false light, or violates any other legal rights of such third person. User agrees that DoD will have the right to control the defense of any such action.
